These Terms & Conditions (“Terms”) govern your access to and use of MINDFUL FC online programs, courses, educational resources, and related services (collectively, the “Services”).
The Services are provided by MINDFUL SPORTS AG LLC, doing business as MINDFUL FC (“MINDFUL FC,” “we,” “us,” or “our”).
By creating an account, enrolling in a program, purchasing a Service, or accessing our online programs, you agree to these Terms. If you do not agree with these Terms, please do not purchase, enroll in, or use the Services.
1. About MINDFUL FC
MINDFUL FC is an education and development platform operated by MINDFUL SPORTS AG LLC, doing business as MINDFUL FC, focused on transforming youth sports from the inside out.
Our Services provide educational and professional-development resources related to mindfulness, leadership, coaching, youth sports, wellbeing, and organizational environments.
Our programs are designed for adults, including parents, coaches, leaders, clubs, and professionals working in or around youth sports.
2. Educational Disclaimer
MINDFUL FC provides educational and professional-development information.
Our programs and materials are not medical, psychological, legal, financial, or other specialized professional advice and are not intended to replace advice from a qualified professional.
Participation in a MINDFUL FC program does not create a therapist-client, physician-patient, attorney-client, or other professional relationship unless expressly stated in a separate written agreement.
You are responsible for determining how the information and practices presented through our Services apply to your circumstances.
3. Accounts and Access
Certain Services require you to create an account.
You agree to provide accurate and current information and to keep your account information secure.
You are responsible for activity occurring through your account and must not share your login credentials or permit unauthorized persons to access your account or purchased program.
MINDFUL FC may suspend or terminate access where we reasonably believe an account is being misused, shared, used unlawfully, or used in violation of these Terms.
4. Programs, Enrollment, and Availability
Program descriptions, curriculum, instructors, schedules, availability, pricing, and other details may change from time to time.
We may update or modify program content when reasonably necessary to improve the educational experience, maintain the program, or reflect changes in our methodology or services.
Where a specific program or service is subject to separate terms, agreements, registration requirements, refund policies, or payment conditions, those terms will apply in addition to these Terms.
5. Purchases and Payments
Certain Services require payment.
Prices and applicable payment terms will be presented before you complete your purchase.
By purchasing a Service, you authorize the applicable payment processor to process the payment method you provide for the amount presented at checkout.
Payments may be processed by third-party payment providers such as Stripe or other payment processors made available through our platform. MINDFUL FC does not generally store complete payment-card information.
You are responsible for providing accurate billing and payment information.
6. Refunds and Cancellations
Any refund, cancellation, or withdrawal rights applicable to a particular program will be presented at the time of purchase or in the applicable program-specific terms.
If no separate refund policy is provided, purchases are generally non-refundable once access to digital program materials has been provided, except where a refund is required by applicable law or MINDFUL FC expressly agrees otherwise.
Nothing in these Terms limits any non-waivable consumer rights you may have under applicable law.
7. Program Access and Digital Materials
Unless otherwise stated, access to a purchased program is provided for the individual purchaser for the period specified for that program.
Program access is personal and may not be transferred, sold, sublicensed, shared, or provided to another person without prior written permission.
MINDFUL FC may restrict or terminate access where there is unauthorized sharing, copying, redistribution, or other material misuse of program content.
8. Intellectual Property
All MINDFUL FC program materials—including videos, audio, text, workbooks, playbooks, guides, exercises, graphics, presentations, curriculum, frameworks, methodologies, terminology, and other educational content—are owned by or licensed to MINDFUL SPORTS AG LLC unless otherwise stated.
The MINDFUL Framework and associated methodologies and educational materials are proprietary to MINDFUL FC.
Your purchase or enrollment gives you a limited, personal, non-exclusive, non-transferable right to access and use the purchased materials for your own educational or, where expressly permitted, internal organizational purposes.
It does not transfer ownership of the materials or grant you the right to reproduce, modify, distribute, publish, teach, sublicense, sell, license, or commercially exploit them.
If you wish to use MINDFUL FC materials in a club, organization, educational program, coaching course, workshop, or other commercial or public setting, please contact us regarding applicable permissions or licensing.
9. Free Resources
MINDFUL FC may provide free guides, reflection resources, educational materials, and other content.
Unless otherwise stated, free resources are provided for personal or internal organizational use and may not be resold, redistributed, republished, or commercially exploited without prior written permission.
10. User Submissions and Feedback
If you submit feedback, ideas, testimonials, comments, or other material to MINDFUL FC, you confirm that you have the right to provide that material.
You agree not to submit material that is unlawful, misleading, defamatory, infringing, abusive, or otherwise inappropriate.
Submitting feedback does not automatically give MINDFUL FC permission to publicly identify you or publish your testimonial. Where we wish to use a testimonial or other identifiable submission publicly, we will obtain appropriate permission.
11. Third-Party Platforms and Services
Our Services may be delivered through third-party platforms and providers, including Thinkific and payment, email, hosting, analytics, or other technology providers.
Your use of a third-party platform may also be subject to that provider's own terms and privacy policies.
MINDFUL FC is not responsible for the independent operation, availability, security, or policies of third-party services beyond our reasonable control.
12. Disclaimer
We make reasonable efforts to provide accurate and useful educational content. However, we do not guarantee that all program materials are complete, current, accurate, or error-free.
Educational results and outcomes vary between individuals and organizations. MINDFUL FC does not guarantee any particular personal, professional, organizational, athletic, financial, or other outcome from participation in our Services.
The Services are provided on an “as available” basis to the maximum extent permitted by applicable law.
13. Limitation of Liability
To the maximum extent permitted by applicable law, MINDFUL SPORTS AG LLC, doing business as MINDFUL FC, and their respective owners, officers, employees, contractors, instructors, and representatives will not be liable for indirect, incidental, consequential, special, or punitive damages arising from or relating to your use of, or inability to use, the Services or program materials.
To the maximum extent permitted by applicable law, our total liability arising from a paid Service will not exceed the amount you paid to MINDFUL FC for that particular Service.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
14. Suspension or Termination
We may suspend or terminate access to a program or account where you materially violate these Terms, engage in unauthorized sharing or distribution of program materials, or otherwise misuse the Services.
Termination or suspension does not affect rights or obligations that, by their nature, should continue after termination, including intellectual-property protections, payment obligations, disclaimers, and limitations of liability.
15. Changes to Programs and Terms
We may update, modify, suspend, or discontinue portions of our Services when reasonably necessary.
We may also update these Terms from time to time. Updated Terms will be posted with a revised “Last updated” date.
For material changes affecting an existing paid program, we will provide notice where required by applicable law.
16. Governing Law
These Terms are governed by the laws applicable to MINDFUL SPORTS AG LLC and the jurisdiction in which it is established, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Any dispute arising from these Terms or your use of the website will be subject to the applicable courts and jurisdiction permitted under applicable law.
17. Privacy
Our collection and use of personal information is described in the MINDFUL FC Privacy Policy, which forms part of the terms governing your use of the Services.
